Colorado SB299 Consumer Protection Plan

The Colorado Legislature passed Senate Bill 25-299, which establishes additional consumer protection requirements for residential solar and solar + battery originations. LightReach and our EPC/Install partners must comply with two primary changes.


What's Changing

1. Contract / Agreement Terms

The law requires additional disclosures to be embedded in all Palmetto LightReach PPA and/or Lease Agreements. An updated Agreement template with the required disclosures has been completed within our portal and systems. No action is needed from partners on this item.

2. Welcome Call (Partner Action Required)

The law requires a recorded Welcome Call to be conducted with the customer at the point of contract signature. This requirement is implemented by Palmetto LightReach partners and enforced by the Palmetto LightReach POPS and QC Teams.

LightReach will begin enforcing Welcome Call compliance on every Colorado project starting September 1, 2026.


Partner Requirements – Welcome Call

Palmetto LightReach licensed EPC/Installation Partners, together with any sales partner they work with, must conduct a recorded Welcome Call prior to or within 2 days of the date the customer signs their Palmetto LightReach Lease or PPA Agreement.

  • The customer's 10-day right to cancel does not begin until the Welcome Call is completed.

  • The state's minimum rescission period is 3 business days; Palmetto's policy is 10 days.

Submission

Proof of a compliant Welcome Call must be submitted to Palmetto LightReach as part of Colorado's M1 Requirements.

Required Welcome Call Content

A compliant Colorado Welcome Call recording must include the following information, verbally delivered and acknowledged by the customer:

  1. Identity of the Consumer – Confirm the customer's identity.

  2. Price of the System – State the price of the residential solar electric system or residential battery energy storage system (i.e., the customer's monthly PPA/Lease amount).

  3. Project Description – Provide a description of the project, including:

    • System size expressed in AC and DC kilowatts

    • Battery energy storage system to be installed (if applicable), including kWh capacity

    • A statement that a residential solar electric system will not provide backup power without being paired with a battery energy storage system

  4. Duration of the Agreement – State the lease or PPW agreement term in years.

  5. Right to Cancel – Inform the customer of their right to cancel the agreement without financial penalty within 10 days of signing.
